2) General Provisions
The General Terms and Conditions apply to the sale and delivery of goods as well as the provision of services by our company. By ticking the checkbox in the shopping cart before submitting the order (“AGB read and accepted”), the buyer agrees to these General Terms and Conditions and is bound by them.
Our product range is non‑binding. The order placed by a fully competent customer (persons aged 18 or older) constitutes an offer to conclude a purchase contract. The confirmation of receipt of the order sent by us in accordance with § 10 (2) ECG does not yet constitute acceptance of the offer.
The purchase contract is only concluded once we dispatch the ordered goods, send a second email as an order confirmation, or otherwise accept the customer’s offer. All offers on our website are subject to change, non‑binding, and available only while stocks last.

3) Ordering Process, Order Correction, Order Cancellation
Once you have selected the desired product, you can place it in the shopping cart without obligation by clicking the button [Add to cart]. You can view the contents of the shopping cart at any time by clicking the button [Cart]. You may remove products at any time by clicking the trash‑bin icon [Remove]. If you wish to purchase the products in your cart, click the button [Proceed to checkout]. Please then enter your data. For your first order, you may either order immediately without registration by clicking [Order without registration], or create a customer account by clicking [Create new customer account]. For future orders, simply enter the login and password you chose during your initial registration. Your data is transmitted in encrypted form. After entering your billing and delivery address and selecting the shipping and payment method, click [Continue with order] to reach the order summary. On this page, you may review your entries, add a comment to your order, or make corrections. By clicking the button [Place order with obligation to pay], you complete the ordering process. You may cancel the ordering process at any time by closing the browser or tab.

4) Contract Language
The content of the contract, all other information, customer service, data information and complaint handling are offered in German.

5) Prices
The prices valid at the time of the order include statutory VAT plus all shipping costs incurred. They are visible before the conclusion of the contract in the shopping cart and afterwards in a contract confirmation sent to the customer. Should export or import duties become due during shipping, these shall also be borne by the purchaser (you can obtain information from your responsible customs office).

6) Right of Withdrawal
Information on the conditions and consequences of the right of withdrawal is listed in the following withdrawal policy:

WITHDRAWAL POLICY

Right of Withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason. The statutory withdrawal period is 14 days from the day on which you or a third party, who is not the carrier, have taken possession of the goods, or in the case of partial deliveries, the last item.

To exercise your right of withdrawal, you must inform us (Humann OG, Mariatrosterstrasse 172g, A‑8044 Graz, Email: shop@atte.at, Tel.: 0664 28 14 423, Fax: 0316 39 43 60) of your decision to withdraw from this contract by means of a clear statement (e.g. an email). You may use the withdrawal form provided by us, but this is not mandatory. To meet the withdrawal deadline, it is sufficient that you send the notification of exercising your right of withdrawal before the withdrawal period expires.

Consequences of Withdrawal
In the event of a valid withdrawal, we shall reimburse you for all payments we have received from you, including delivery costs (except for additional costs arising if you chose a type of delivery other than the cheapest standard delivery offered by us), without delay and at the latest within 14 days from the day on which we received the notification of your withdrawal. We may refuse reimbursement until we have received the goods back or until you have provided proof that the goods have been returned, whichever is earlier. For this reimbursement, we use the same means of payment that you used in the original transaction, unless expressly agreed otherwise. Under no circumstances will you be charged any fees for this reimbursement.

Please send the goods back to us without delay and in any case no later than 14 days from the day on which you informed us of the withdrawal of this contract, to:

Please return the item to us, if possible, complete and in its original packaging. Please use the return slip (enter the reason for return) and enclose it with the package. The use of the return slip and the original packaging is not mandatory, i.e., it is not a prerequisite for exercising your rights, but it simplifies and ensures the processing for us.

If the customer is an entrepreneur, the right of withdrawal is entirely excluded. Withdrawal Form

The deadline is met if you send the goods before the period of fourteen days has expired. If you cannot return the received goods or benefits (e.g. usage advantages) at all, only partially, or only in a deteriorated condition, you must compensate us for the loss in value. You are only required to pay compensation for deterioration of the goods and for any derived benefits if the deterioration or benefits result from handling the goods in a manner that goes beyond what is necessary to examine their condition, properties, and functioning. “Examination of the condition, properties, and functioning” refers to testing and trying out the goods as would be possible and customary in a retail store.

The right of withdrawal does not apply, unless otherwise agreed by the parties, to the following contracts:

  • Contracts for the supply of goods that are not prefabricated and for which an individual selection or specification by the consumer is decisive, or which are clearly tailored to the personal needs of the consumer,
  • Contracts for the supply of sealed goods which are not suitable for return for reasons of health protection or hygiene, if their seal has been removed after delivery,
  • Contracts for the supply of goods which, due to their nature, have been inseparably mixed with other items after delivery,
  • Contracts for the supply of audio or video recordings or computer software in a sealed package, if the seal has been removed after delivery.
  • The consumer bears the direct costs of returning the goods. For freight forwarding goods / goods not suitable for standard postal shipment, the return shipping costs are estimated at a maximum of 200 euros. We may refuse to accept shipments sent freight collect and treat them as not returned.

7) Payment
We strive to ship the goods quickly and also offer new customers the option to make payment immediately.

We accept the following payment methods: cash on collection, invoice, advance bank transfer, Klarna Checkout, PayPal Express, or credit card payments. Payment processing is carried out directly via the payment platform of Mollie or PayPal.

For the payment method “cash on collection,” you pay the invoice amount in cash when collecting the goods.

For the payment method “advance bank transfer,” the customer must make the payment within one week of receiving the order confirmation. Our bank details are:

The bank details will also be sent to you in the order confirmation email. Delivery will only take place after payment has been received.

8) Reminder and collection fees
In the event of default, even if the payment delay is not the customer’s fault, the contractual partner undertakes to reimburse us for all reminder and collection fees that are necessary for appropriate legal action and proportionate to the claim. In particular, the contractual partner agrees to reimburse the costs incurred by engaging a debt collection agency, provided these do not exceed the maximum rates permitted for such agencies. If we handle the reminder process ourselves, the debtor agrees to pay an amount of EUR 12 per reminder, as well as EUR 5 per half-year for maintaining records of the outstanding debt.

9) Default of acceptance
If a customer who has placed an order as an entrepreneur is in default of acceptance, we are entitled to store the goods at our premises and charge a storage fee of EUR 0.1 for each calendar day or part thereof. At the same time, we insist on fulfillment of the contract.

10) Retention of title
We retain ownership of the delivered service or goods, as well as any media processed or created by us, until all payments arising from the business relationship with the customer have been received. If the customer resells goods subject to retention of title, they must also pass on the retention of title. The customer must immediately notify us of any third-party access to goods subject to retention of title. Pledging, transfer by way of security, or similar dispositions of such goods are only permitted with our prior consent. If payment is not made immediately after a reminder in the event of default, the goods subject to retention of title must be returned without delay. The costs of return shall be borne by the customer.
